This Terms and Conditions Agreement (“Agreement”) outlines the rules, responsibilities,
and policies associated with participation in swimming lessons provided by Family
Aquatics (“Company,” “we,” “us,” or “our”). By enrolling yourself or your child in our
programs, you (“Member,” “Parent/Guardian,” or “Participant”) agree to abide by the
following terms.

1. Enrollment and Deposit

1.1. A refundable deposit of $100.00 (one hundred dollars) is required per participant at
the time of enrollment.
1.2. The deposit secures your place in the program and demonstrates your commitment to
attending lessons.
1.3. The deposit will be refunded after three (3) consecutive months of active
participation, provided all terms outlined herein are met.
1.4. Deposits are non-transferable between participants.

2. First Month Free Promotion

2.1. New members will receive their first month of swimming lessons free of charge.
2.2. To qualify for this promotion, the participant must remain enrolled for a minimum of
three (3) consecutive months.
2.3. If a participant withdraws prior to completing the three-month minimum, the free
month will be forfeited and the deposit will not be returned.

3. Refund of Deposit

3.1. The deposit will be refunded in full if:
• The participant has remained actively enrolled for a minimum of three
consecutive months;
• All fees have been paid in a timely manner after the first month;
• The participant has complied with Family Aquatics’ rules, including attendance and
conduct expectations.
3.2. Refunds will be processed within 14 business days after the completion of the
three-month requirement.
3.3. Refunds will be issued to the original payment method unless otherwise
agreed in writing.

4. Lesson Fees and Payments

4.1. After the free first month, standard lesson fees apply and must be paid monthly in
advance.
4.2. Fees are subject to change, and members will be notified at least 30 days in advance
of any adjustments.
4.3. Missed lessons are non-refundable and non-transferable, except in cases where
Family Aquatics cancels a session.

5. Attendance and Cancellations

5.1. Consistent attendance is expected. Excessive absences may affect progress and
eligibility for a deposit refund.
5.2. Cancellations by participants do not result in refunds or credits.
5.3. Family Aquatics reserves the right to cancel or reschedule classes due to unforeseen
circumstances, including but not limited to inclement weather, facility issues, or instructor
availability. In such cases, make-up lessons or credits may be offered at the Company’s
discretion.

6. Health and Safety

6.1. All participants must be in good health and free from contagious illnesses before
entering the pool.
6.2. Parents/guardians are responsible for ensuring their child is medically fit to
participate in swimming lessons.
6.3. Family Aquatics staff reserve the right to deny participation if a child appears ill or
unfit for lessons.
6.4. Proper swim attire, including swim diapers for young children, is required at all times.

7. Supervision and Conduct

7.1. Parents/guardians must supervise their children outside of lesson times.
7.2. Participants and spectators are expected to demonstrate respectful behavior toward
instructors, staff, and other families.
7.3. Disruptive, unsafe, or inappropriate conduct may result in removal from the program
without a refund.

8. Liability Waiver

8.1. By enrolling in Family Aquatics programs, you acknowledge the inherent risks
associated with swimming and aquatic activities.
8.2. Family Aquatics, its staff, and affiliates are not liable for any injury, accident, loss,
or damage sustained during participation, except in cases of proven negligence.
8.3. Parents/guardians assume full responsibility for the safety of their children before and
after lesson times.

9. Photography and Media

9.1. Family Aquatics may occasionally take photographs or videos for promotional
purposes.
9.2. By enrolling, you consent to the reasonable use of such media unless you provide
written notice opting out.

10. Termination of Enrollment

10.1. Family Aquatics reserves the right to terminate a participant’s enrollment for:
• Failure to comply with this Agreement;
• Repeated absences without notice;
• Safety concerns or disruptive behavior.
10.2. In such cases, deposits and fees may be forfeited.

11. General Provisions

11.1. This Agreement is binding upon enrollment and remains in effect throughout
participation.
11.2. Family Aquatics reserves the right to update or amend these Terms and Conditions
with reasonable notice.
11.3. Any disputes shall be resolved in accordance with the laws of the jurisdiction in
which Family Aquatics operates.

By enrolling in Family Aquatics swimming lessons, you confirm that you have read,
understood, and agree to these Terms and Conditions.
